1. Travel Agreement:

1.1 The General Terms and Conditions apply to all transportation carried out by Kanab Shuttle LLC.

1.2 Once a booking has been made, it is binding after payment is carried out by credit card. To transfer reservation to another date is subject to special approval from Kanab Shuttle LLC.


2. Payment:
2.1 Payment is made only via phone with credit card  by a phone reservation. The payment confirmation slip via email given at the time of booking is a valid ticket for boarding the Kanab Shuttle. 

2.2 Acceptance of the General Terms and Conditions constitutes the conclusion of a legally binding contract. 

2.3 The current prices are per reservation as indicated, and can be found on the website www.kanabshuttle.com unless otherwise stated. 


3. Modification, Changes in Booking, Cancellation:

3.1. The reservation is only valid for the person named in the booking. 

3.2 Reservations that are not made use of become invalid and the transfer price is not refunded. A future claim for services is not permissible. 

3.3 Should the reservation be subject to considerable difficulty for reasons beyond the control of Kanab Shuttle LLC, become dangerous or impossible, Kanab Shuttle LLC., is entitled to cancel the transfer and the costs of the transfer will be refunded to the passenger. No later claim can be made. 

3.4 Kanab Shuttle is entitled to cancel the reservation if the reservation is endangered through any action or negligence on the part of a passenger or if there is danger of harm to other passengers sharing the same reservation due to such action or negligence. In this event Kanab Shuttle, refunds the transfer costs to this passenger. No further claim exists. 

3.5 Kanab Shuttle reserves the right to carry out minor changes to the reservation if necessary, and to such extent that these do not result in major changes to transfer times.

3.6 In the event of cancellation or non-appearance at the time of transfer, no refund will be made. No later claim can be considered. 

3.7 The fee for changes to a reservation is $10.00 per reservation and per person. 


3.8  The Kanab Shuttle LLC, departure times are scheduled to allow sufficient time to reach passengers when the reservation is made correctly, however they do not take delays into consideration. Should delays occur due to hold-ups, accidents, congested road and airport traffic, diversions etc.  Kanab Shuttle LLC, cannot be held responsible for arriving on-time. Eventual delays must be taken into consideration when booking. 

3.9 Kanab Shuttle LLC endeavors to convey the customer to his/her accommodation by the most direct route without any detours to other destinations. Should organizational reasons or adverse weather conditions make it impossible to drive directly to the accommodation site, Kanab Shuttle LLC, will arrange an alternate route to reach the intended destination. If a change of vehicle is necessary no extra cost is incurred. A refund cannot be claimed. 


4. Insurance

4.1 Travel cancellation insurance is not included in the transfer price, it is however recommended by Kanab Shuttle LLC.


5. Luggage

5.1 The driver is obliged to observe all safety measures required to ensure a safe journey. The driver will be responsible for the loading and unloading of the luggage during the time of your transportation. 

5.2 It is the customer’s responsibility to check that his/her luggage is loaded onto the vehicle and later unloaded. Luggage is generally transported in the same vehicle or in a small cargo trailer towed behind the main vehicle.
5.3 If luggage is not packed appropriately for transport the driver is entitled to refuse to convey the luggage. 

5.4 Kanab Shuttle LLC does not accept liability for any damage to luggage caused by other items of luggage.


6. Transportation of Children and Frail Persons 

6.1 According to the laws governing the conveyance of passengers, all persons (any age) must occupy a seat of their own, and use a safety belt during transportation. This is included in the general charge. If seats for children are required, please inform us at the time of booking. 

6.2 If there is risk of danger for the transfer due to the fact that a guest represents a danger to himself on the grounds of his physical or mental state, no liability can be accepted for bodily damage, including death. 


7. Refusal of Conveyance:

7.1 Kanab Shuttle LLC can refuse transportation in the event of any of the following circumstances: 
- conveyance would represent a danger for the safety or the health of the other passengers or of the driver or would represent an unreasonable burden. 
- the mental or physical state of a passenger, and especially any impairment arising from alcohol or drug abuse, represents a danger or risk to the passenger him/herself, to the other passengers or to the driver. 
- the passenger is not able to present either confirmation of the reservation or a reservation number. 

7.2 Cooperation

7.3 The customer is obliged to make any complaints known to the local driver immediately. The driver is instructed to resolve the situation as far as possible. Should a passenger negligently fail to inform the driver of any discrepancy, no claim for reduction of costs can be considered. 


8. Complaints Procedure, Time Limit for Claims, Statutory Period of Limitation

8.1 If a fault has not be wholly or partly remedied, a report must be written in cooperation with the driver. The customer must assert claims against Kanab Shuttle LLC for transfers not carried out according to the agreement. Any claims must be made in the written form.

8.2 The statutory period of limitation for claims relating to transfer that has not been conducted in accordance with the agreement is 6 months after the transfer has been mutually agreed. 


9. Data Protection and Data Safety

9.1 Personal date such as name, address, credit card details are necessary for the reservation. The data supplied is processed electronically, saved and forwarded within the limitations of the purpose of the agreement. Data relating to persons is protected by the federal laws governing data protection. 


10. Liability

10.1 Kanab Shuttle LLC accepts no liability for direct or subsequent damage unless there is evidence that this has been caused due to negligence or intent on the part of Kanab Shuttle LLC.  In no event will the amount exceed the sum of the damaged proved. 

10.2 Should international agreements or regulations based on such provide for restrictions of liability for services carried out on behalf of Kanab Shuttle LLC can refer to such in the event of damages. 


11. Legal Domicile

11.1 Any disputes arising from this agreement will be settled before the Court of Law in the State of Utah.


12. Other Regulations and Agreements

12.1 These terms apply unless individual agreements are entered into. 

12.2 The above terms apply only if legal provisions enforced after the time of printing do not provide for other regulations. 

12.3 If any of the terms become ineffective, this does not affect the agreement as a whole.
